Patna: The Patna high court has quashed a criminal case registered against former president of Bihar Cricket Association (BCA) Rakesh Kumar Tiwary.A local court in Patna had initiated criminal proceedings against Rakesh by its order of May 5 last year, taking cognizance of a complaint filed by Sheela Tiwary alleging extortion by the former BCA president.A single bench of justice Soni Shrivastava, in its verdict of Oct 15, 2026, quashed the cognizance order of May 5 last year while allowing Tiwary’s petition. The high court’s verdict became public on Friday morning.Rakesh’s counsel Navjot Yeshu argued that the allegation of extortion against his client was prima facie malicious and an abuse of the process of law. He said the allegations were vague and malicious as the complainant lodged the case only after Delhi Police approached her to interrogate her husband, Om Prakash Tiwari, whom Rakesh had made a prime accused in a fraud case registered at Parliament Street police station. The high court also found that the Patna magistrate’s court had violated mandatory procedures under the Bharatiya Nagarik Suraksha Sanhita (BNSS), which require notices to be issued to the accused before taking cognizance. The high court quashed the complaint case against Rakesh, calling it a “glaring example of malicious prosecution and abuse of legal process”.
